MARRIAGE REGISTRAR EMPLOYEE CONTEST AND ISLAMIC LAW AGAINST WALI FASIQ IN LANGSA ACEH
Abstract
This paper examines the debate over the dualism of understanding in establishing ungodly guardians in marriages that occurred in Langsa-Aceh between PPN and society against Islamic law. Langsa applies Islamic law like the rest of Aceh in general. It's just that Langsa, more features a cosmopolitan region with various ethnicities and religious understandings that have blended. In terms of sociology, Langsa presents the criteria of a bureaucratic and semi-industrial central city. In these conditions it is interesting to see the understanding of Islamic law and the impact of modern life of the bureaucracy. This research was conducted by the normative method of sociology with additional data from interviews. The results showed that; There is a legal dualism between PPN and society so that most people consider that marriages carried out using ungodly guardians are invalid. And people are more likely to choose the concept of ungodly guardianship elaborated by scholars as the most popular opinion among the shafi'i school about the guardianship of a wicked person is two opinions. Some argue that an ungodly person cannot be a guardian in a marriage contract. Others argue that the ungodly can act as marriage guardians. Marriage with a child guardian is that it affects the child born from the marriage, because the marriage is invalid, the child automatically affects the marriage.
